Fair Use:
This video library site has great respect for artists in all fields, their creative endeavors, and the rights bestowed upon them under U.S. copyright law. Within U.S. copyright law, the doctrine of fair use (Title 17, Chapter 1, § 107) allows for limitations on exclusive rights:
Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.
Most artists recognize that the doctrine of fair use benefits them by publicizing their works, giving their works notoriety and oftentimes cultural prestige, especially when presented by or in association with a nonprofit for teaching, scholarship, or research purposes. Portions of this library site may be presented to the viewer/scholar/researcher under the doctrine of fair use. The fair use criteria are met in several ways:
- This site is noncommercial.
- This site exists for teaching, scholarship, and/or research purposes.
- This site provides a cultural and educational service to the public.
- This site has the same considerations granted any library.
- This library, taken as a whole, meets the definition of transformative, and this is only one example of how the transformative criteria is met.
